Please read these Terms of Service ("Terms") carefully before using Pathsight, GymLens, Eggsplore, Prompt Doctor, or Martina mobile applications (collectively, the "Services") operated by Hev LLC ("us", "we", or "our").
Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Services.
By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Services.
1. Use of the Services
1.1 Eligibility
You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that you are at least 13 years of age and that your use of the Services does not violate any applicable laws or regulations.
1.2 Account Registration
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
1.3 Account Security
You are responsible for safeguarding the password or credentials that you use to access the Services and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
1.4 Acceptable Use
You agree not to use the Services:
- In any way that violates any applicable national or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate Hev LLC, a Hev LLC employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Hev LLC or users of the Services or expose them to liability.
2. Subscription and Payments
2.1 Subscription Options
We offer both free and paid subscription options for our Services. The features available to you will depend on the subscription tier you select. Each app has its own subscription options:
- Pathsight: Monthly ($3.99) and Annual ($19.99) with a 3-day free trial
- GymLens: Monthly ($4.99) and Annual ($24.99) with a 3-day free trial
- Eggsplore: Monthly and Annual Premium subscriptions
- Prompt Doctor: Annual ($9.99) and Lifetime Access ($14.99 one-time payment)
- Martina: Professional subscription plans for pet care businesses
2.2 Payment Terms
If you choose a paid subscription, you agree to pay all fees applicable to your subscription plan. We may change the fees for any subscription service at any time, but any price changes will apply to your subscription only after prior notice to you.
2.3 Automatic Renewal
Unless you cancel your subscription before the end of the applicable subscription period, your subscription will automatically renew, and you authorize us to charge your payment method for another subscription period at the then-current rate.
2.4 Cancellation
You may cancel your subscription at any time through your Apple ID account settings or by contacting us. If you cancel your subscription, you will not receive a refund for the current subscription period, but your subscription will remain active until the end of the current billing cycle.
2.5 Refunds
Refunds will be issued in accordance with applicable laws and at our discretion. Generally, no refunds will be provided for partial subscription periods or for unused portions of a subscription.
3. Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of Hev LLC and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Hev LLC.
4. User Content
When you submit, upload, store, send, or receive content to or through our Services, you give Hev LLC a worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services.
5. Disclaimers
5.1 "As Is" and "As Available"
Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
5.2 No Guarantee of Accuracy
Hev LLC and its subsidiaries, affiliates, and its licensors do not warrant that a) the Services will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Services are free of viruses or other harmful components; or d) the results of using the Services will meet your requirements.
6. Limitation of Liability
In no event shall Hev LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Services.
- Any conduct or content of any third party on the Services.
- Any content obtained from the Services.
- Unauthorized access, use, or alteration of your transmissions or content.
To the maximum extent permitted by applicable law, our total liability to you for any damages shall not exceed the greater of (a) the amounts you paid to us in the six (6) months preceding the event giving rise to the liability or (b) $50.00 USD.
7. Indemnification
You agree to defend, indemnify, and hold harmless Hev LLC and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Services.
8. Binding Arbitration and Class Action Waiver
Any dispute, controversy or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in San Francisco, California, unless you and Hev LLC agree otherwise. Each party will be responsible for paying any filing, administrative and arbitrator fees in accordance with AAA rules.
YOU AND HEV LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Hev LLC agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States of America and the State of California, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

2. Safety Warning
The use of Pathsight while operating a vehicle may be distracting and may increase the risk of an accident. You should always follow traffic rules, road signs, and local regulations, which take precedence over any navigation instructions provided by Pathsight. We strongly recommend:
- Setting up your route before starting your journey
- Using hands-free accessories if you need to interact with the app while driving
- Having a passenger operate the app when possible
- Pulling over safely if you need to make changes to your route
3. No Guarantee of Accuracy

COMPREHENSIVE LIABILITY WAIVER AND ASSUMPTION OF RISK
PLEASE READ CAREFULLY: By using GymLens, you expressly acknowledge and agree that:
- Exercise and fitness activities involve inherent risks that may result in personal injury, illness, permanent disability, or death.
- You voluntarily assume ALL risks associated with using GymLens and performing any exercises or fitness activities suggested by the app, whether known or unknown.
- Hev LLC, its owners, officers, employees, agents, and affiliates are NOT responsible for any injuries, accidents, illnesses, damages, or losses that may occur from using GymLens or following any exercise routines, suggestions, or guidance provided through the app.
- You hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE Hev LLC from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by you while using the app or performing exercises suggested by the app.
